By registering, accessing, or using Investika (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms form a legally binding agreement between you and Investika Limited ("we", "us", "our"), a company licensed by the Betting Control and Licensing Board (BCLB) of Kenya.
You must be at least 18 years of age to use this Platform. By registering, you confirm that: (a) you are a natural person aged 18 or older; (b) you are a resident of Kenya or a jurisdiction where prediction market trading is not prohibited; (c) you are not a person who has self-excluded from gambling services; (d) you are not acting on behalf of another person. We verify age and identity via Smile Identity's national ID verification service. Any false declaration is a breach of these Terms and may result in immediate account closure and forfeiture of funds.
You must complete Know Your Customer (KYC) verification before placing trades or withdrawing funds. You must: (a) provide a valid Kenyan National ID; (b) submit a selfie for facial recognition matching; (c) ensure all information is accurate and up to date. We reserve the right to refuse or suspend accounts where verification cannot be completed. Submission of false documents is a criminal offence under the National Registration Bureau Act.
Investika operates a prediction market where users buy YES or NO shares on the outcome of real-world events. Share prices are determined by a Logarithmic Market Scoring Rule (LMSR) algorithm. Key terms: (a) Each winning share resolves at KES 1.00; (b) A 2% platform fee is deducted from each trade; (c) Withholding Tax (WHT) of 20% applies to the profit component of winning payouts as required by Kenya Revenue Authority (KRA) regulations; (d) Markets may be voided at our discretion if the resolution criteria cannot be determined — all stakes are refunded in full in such cases; (e) Settlement decisions by our admin team are final once confirmed by dual-approval.
All transactions are in Kenyan Shillings (KES) via M-Pesa. (a) Minimum deposit: KES 50; Maximum single deposit: KES 150,000; (b) Minimum withdrawal: KES 100; Maximum single withdrawal: KES 70,000; (c) Daily deposit and withdrawal limits apply per regulatory requirements; (d) Withdrawals require completed KYC and OTP verification; (e) We are not responsible for M-Pesa network delays or failures beyond our control; (f) Funds may not be transferred between accounts.
We are committed to responsible gambling. You may at any time: (a) Set daily deposit and loss limits via your account settings; (b) Take a cooling-off period of 1, 7, or 30 days; (c) Permanently self-exclude from the Platform. Self-exclusion is irrevocable for the duration chosen. We will honour self-exclusion requests from other BCLB-licensed operators where notified. You must not: (a) use automated bots, scripts, or algorithms to trade; (b) collude with other users to manipulate market prices; (c) use multiple accounts; (d) use stolen payment methods or engage in money laundering; (e) attempt to reverse-engineer or attack the Platform; (f) share your account credentials with any other person. Violation of these rules will result in immediate account suspension, balance forfeiture, and referral to relevant authorities.
All Platform content — including the LMSR trading engine, UI design, logos, and market data — is the property of Investika Limited. You are granted a limited, non-exclusive licence to use the Platform for personal, non-commercial purposes only.
Trading on prediction markets involves financial risk. You may lose some or all of your deposited funds. We do not guarantee any return. The Platform is provided "as is". To the maximum extent permitted by Kenyan law, we exclude all implied warranties. Our total liability to you for any claim shall not exceed the amount you deposited in the 30 days preceding the claim.
These Terms are governed by the laws of Kenya. Any disputes shall first be referred to mediation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya. For complaints, contact: support@predictea.co.ke or the BCLB at www.bclb.go.ke.
We may update these Terms at any time. Material changes will be notified via SMS or email at least 7 days before taking effect. Continued use of the Platform after that date constitutes acceptance.
